Documentation;
1. Documents for Service
We require two documents per person to be served. Original copies are required for Service, legible
photocopies are required for preparation of affidavit or in some cases left at address for "problem" services where
we will retain originals for substitute service.
For Divorce Documents you need to include the following;

a sealed copy of the Application for Divorce and any other documents you
have filed with the Court, except the photocopy of the marriage certificate
-
a copy of the 'Marriage, Families and Separation' brochure,
and
-
an Acknowledgment of Service (Divorce). (Optional, it comes as a
standard with Divorce Kits however we prefer to prepare using our own software programs for you along
with our Affidavit of Service).
2. Photo of
Respondent/Defendant In Family Law matters, or Civil Matters where
you consider the person may avoid service you can include a photo of the person and under some Court Rules we
can effect Service on the person as sighted in the photo and have it endorsed by the
Applicant/Plaintiff
3. Time Limits for Service of
Docs
Each Court (Local/District/Supreme/Family etc) has different rules for time limits for Service of Docs. If you
have Divorce Documents they must be served at least 28 days before the
court hearing date. Please Contact Us if in doubt.
4. Payment Full payment as shown on the Standard Rates &
Charges page MUST accompany your application if you do not have an account or arrangement made with us before
sending the documents. All Cheques or Money Orders to be made to "ARCS Mercantile".
Do Not Send Cash. Payment can be made by EFTPOS/Visa/Mastercard at our office, you must be the card holder. If
there are other charges these will be added and payment required to settle account before return of
documents/Acknowledgment/Affidavit.

Every effort
is made to ensure service is effected by required date however we are unable to make a 100% guarantee of delivery
documents to to variable circumstances.
Standard Rates & Charges are per Defendant, per Address.
Where documents are served at the same time at the
same address (multiple defendants), you will only normally be are only
charged for One Defendant at that Address.
A minimum of 3 attempts will be made to serve documents (unless
person no longer resides at address or threated with violence) at various times of day, night & weekends.
Rural/Remote & Interstate work may incurr costs for each
attempt.
Charges will apply for Attempted Service at an address even if
documents can not be Served. There are no refunds or "free work" once we commence work on any
matters.
Please allow 7 days from receipt of documents for update on
status of Process Service unless URGENT. Do not contact the other party within this time and cause any
anamosity with them before we arrive. You will be notified upon Service and informed of any incidents or
problems with the other
party.
If our agents discover the Defendant/Respondent/Witness has left
the given address and locates a new address to serve the documents, they will automatically attend the new
address if in the same locality to serve the document unless otherwise instructed. Additional Charge will be
added to invoice for new address
attended.
Subpoena documents require Conduct Money, preferably a cheque
made to the Witness to be sent with the documents. If Nil or incorrect Conduct Money supplied, money will
required to be Paid in Full to us before documents served, additional charges
apply
All Standard Rates & Charges are based on being provided
adequate time to complete the task required and return the Affidavits & Documents by standard post.
URGENT matters, NSW Country / Interstate services will incurr Express Post or Courier Charges added to
invoice.
ARCS Mercantile take NO responsibility for the accuracy,
legality, or content of the documents sent to us. Responsibility is purely with the issuer (Plaintiff,
Applicant, Solicitor, Agent etc - ie: Not ARCS
Mercantile)
