Process
Services include (but not limited to):
v Legal letters, correspondence, notice of intended
repossession.
v Statements of Claim (All Local, District, Supreme
Courts)
v Subpoenas, Garnishee Orders, Examination
Notices/Orders
v Bankruptcy notices, Creditors Petitions (Federal Magistrate
Courts)
v Family Law/Federal Court documents.
v Local, District, Supreme Court documents.
We provide
Affidavits of Service, Acknowledgments of Service, Affidavits of Attempted Service and Service Reports as applicable for all documents as
required.
If your
client has “skipped” (moved intentionally without notifying you) we:
v Use ‘skip tracing techniques’ through a range of databases
and public records.
v Follow up any leads personal, business, family.
v Attend any new addresses found and interview the client and
establish new information.
Other Important Information;
v Every effort is made to ensure service is effected by required date however we are unable to
make a 100% guarantee of delivery documents to to variable
circumstances.
v Standard Rates & Charges are per Defendant, per Address. Where documents are served
at the same time at the same address (multiple defendants), you will only normally be are only charged for One Defendant at
that Address.
v Charges may be required to be paid "in advance" for non-account customers (at our
decision) before we return affidavits or documents. Please see our
Terms of Trade and General Conditions or Contact Us before before sending
documents.
v Please supply as much information about defendant/respondent (Home & work address,
phone numbers, description/photo, vehicle rego, time of day expected
home etc)
to assist with Service of
Documents
.
v A minimum of 3 attempts will be made to serve documents (unless person no longer resides at
address or threated with violence) at various times of day, night & weekends. Rural/Remote &
Interstate work may incurr costs for each
attempt.
v Charges will apply for Attempted Service at an address even if documents can not be Served.
There are no refunds or "free work" once we commence work on any
matters.
v If our agents discover the Defendant/Respondent/Witness has left the given address and locates
a new address to serve the documents, they will automatically attend the new address if in the same
locality to serve the document unless otherwise instructed. Additional Charge will be added to
invoice for new address
attended.
v Subpoena documents require Conduct Money, preferably a cheque made to the Witness to
be sent with the documents. If Nil or incorrect Conduct Money supplied, money will required to
be Paid in Full to us before documents served, additional charges
apply.
v All Standard Rates & Charges are based on being provided adequate time to complete the
task required and return the Affidavits & Documents by standard post. URGENT matters, NSW Country /
Interstate services will incurr Express Post or Courier Charges added
to invoice.
v ARCS Mercantile take NO responsibility for the accuracy, legality, or content of the documents
sent to us. Responsibility is purely with the issuer (Plaintiff, Applicant, Solicitor, Agent etc - ie:
Not ARCS

v By Sending work to ARCS Mercantile you agree to our Standard
