Repossession
ARCS Mercantile specialise in this field and are available to enact quick recovery of money
or property as required.
Our operators and agents are experienced in all types of personal
and business leased or mortgaged goods.
We:
v •Provide proper written instructions to our operators tailored to individual task
requirements.
v •Work to proper legislative requirements (ie Uniform Credit Code, guidelines set forth
by ACCC & ASIC etc).
•v Attend specific and given
addresses, request Payment In Full of all arrears and costs.
v •If payment available we will
collect in Certified Funds, if not will secure property
(vehicle or equipment) and store / transport to your nominated address.
v Conduct an visual inspection,
provide a condition report including photographs and
include any comments, issues that occurred with debtor/client/family etc at time
of repossession.
v •Arrange return of any
personal effects to client that were not subject to the
credit agreement.
v Advise initially as
soon as taken possession and follow through with a more detailed
Service Report as soon as
possible.
If your client has “skipped” (moved intentionally without
notifying you) we:
v Use ‘skip tracing techniques’ through a range of databases
and public records.
v Follow up any leads personal, business, family.
v Attend any new addresses found and interview the client and
establish new information.
Evictions & Lockouts
ARCS Mercantile represent business and individuals in lawful evictions and lockouts of residential, commercial
and rural properties.
We:
v Attend evictions on your behalf to minimise any risk to your
staff.
v Arrange locksmiths and forwarding of keys to nominated person
or agent.
v Consult with clients to repair any damage necessary to secure
premises.
v Arrange Qualified contractors for Repairs to damage or cleaning, painting,
gardening
to make property suitable for
sale.
v Supervise, photo and
video removal of any belongings left after eviction has been
completed.
v
Provide written report including pictures
of property at time of eviction.
v Conduct any
pre-eviction field call (if required) if property considered a risk or may have intentionally skipped beforehand and can be immediately
secured.
v Remove any domestic pets and arrange care or collection as
necessary.
v Advise initially as
soon as taken possession and follow through with a more detailed
Service Report as soon as
possible.
Other Important Information;
v Charges may be required to be paid "in advance" for non-account customers (at our
decision). Please see our Terms of Trade and General Conditions or Contact Us before before sending
instructions.
v Provide Accurate instructions of Creditors requirements &
expectations.
v Provide as much information known about the debtor and account history as
possible. (Home & work address, phone numbers, default notice, Up to Date
Statement).
v Provide Accurate information about goods & delivery address where to be sent
to.
v A minimum of 4 attempts will be made to given address (unless debtor no longer
resides at address or threated with violence) at various times of day, night & weekends.
Rural/Remote & Interstate work may incurr costs for each
attempt.
v Charges will apply for each address attended even if debtor is not located. When visiting
multiple addresses we may charge at lower hourly rate if addresses are in same locality and more cost
effective for Agent and
customer.
v Minimum charge will be for Field Call to each address attended regardless of if money is paid
or goods
collected
v There
are no refunds or "free work" once we commence work on any
matters.
v If our agents discover the Debtor has left the given address and locates a new
address, they will automatically attend the new address if in the same locality unless otherwise
instructed. Additional Charge will be added to invoice for new address attended and will report on
those
findings.
v All Standard Rates & Charges are based on being provided adequate time to complete the
task
required.
v Goods collected are handled with all care however we take no responsibility for any damage or
breakage once in our
possession.
v When ARCS Mercantile organise a Towing Contractor the charges and payment of their
invoices are required by the due date. This also applies if the vehicle is not
collected.
v
If we discover from Towing Contractor's that their invoices are Overdue and not being paid
then we may commence Debt Collection against the issuing company or Creditor and our Overdue Invoices
Charges from our Terms of Trade and General Conditions will be added to the costs for the original Towing
Contractor's invoice charges. (It is very hard for our Field Agents to organise Towing Contractors when other
Agents / Creditors have not paid their
previous invoices.
v ARCS Mercantile take NO responsibility for the accuracy, legality, or content of
information sent to us. Responsibility is purely with the issuer (Creditor, Plaintiff,
Solicitor, Agent etc - ie: Not ARCS
Mercantile)
